1. Acceptance
By purchasing or downloading ProbeScope, you agree to these Terms and to the End User License Agreement.
2. Licensing tiers
ProbeScope is offered under four tiers - Free, Pro, Team, and Enterprise - each with distinct feature limits and seat counts, described on the Pricing page. Pro is a one-time purchase; Team and Enterprise are annual subscriptions billed in advance.
3. Payment and renewal
Payments are processed by Stripe. Team and Enterprise subscriptions renew automatically each year unless cancelled prior to the renewal date. Pro is billed once and does not renew.
4. Refund Policy
Users are encouraged to evaluate ProbeScope using the free version or trial before purchasing a paid license. Accordingly, all purchases of paid licenses are final, and no refunds or credits will be provided.
Notwithstanding the foregoing, Secimo GmbH may, at its sole discretion, issue a refund in exceptional circumstances, including but not limited to duplicate payments, billing errors, or other circumstances Secimo GmbH considers appropriate. Requests should be sent to support@probescope.net.
Nothing in this Refund Policy limits or excludes any rights that cannot be waived under applicable mandatory consumer protection laws.
5. Subscription Cancellation
If the ProbeScope is provided on a subscription basis, users may cancel their subscription at any time by contacting us at support@probescope.net. Cancellation will prevent future renewal charges but will not entitle the user to a refund of any fees already paid for the current subscription period.
Unless otherwise stated at the time of purchase, the user will continue to have access to the subscribed services until the end of the current billing period, after which the subscription will terminate automatically.
Where subscriptions renew automatically, the user authorizes Secimo GmbH to charge the applicable subscription fee at the beginning of each renewal period unless the subscription is cancelled before the renewal date.
6. Warranty disclaimer & limitation of liability
ProbeScope is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from use of the software, including damages resulting from missed or delayed outage detection.
7. Governing Law and Jurisdiction
These Terms are governed by the laws of Switzerland, excluding its conflict of laws rules. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Zurich, Switzerland, unless mandatory law provides otherwise.
